Terms and Conditions

These Terms and Conditions apply to purchases made from the Tropaquatics website. Please read them before placing an order.

In these terms, “Tropaquatics”, “we”, “us” and “our” refer to Tropaquatics LTD. “You” and “your” refer to the person placing an order.

2. These terms

By placing an order, you confirm that:

  • You have read and accepted these terms;
  • The information you provide is complete and accurate;
  • You are legally capable of entering into a contract; and
  • If purchasing livestock, you are at least 18 years old.

Nothing in these terms affects your statutory consumer rights.

3. Products and livestock

We take reasonable care to describe and display our products accurately.

Photographs of livestock are representative unless the listing states that the exact animal pictured will be supplied. Natural differences in colour, pattern, markings, body shape and fin shape may occur.

Sizes are approximate and are normally measured from the front of the head to the end of the tail unless otherwise stated. Minor differences in size are not normally considered faults.

Any statement about the sex of livestock is based on our reasonable assessment. Unless a listing expressly guarantees the sex, sexing should be treated as an informed estimate and cannot be guaranteed.

Colours may look different because of lighting, photography, transport stress, age, sex, environment and screen settings.

Product packaging and manufacturer specifications may change. Any substitution will be equivalent and will not materially reduce the product's quality or function without your agreement.

4. Livestock suitability and welfare

You are responsible for researching an animal's adult size, care requirements, diet, temperament and compatibility before ordering.

Livestock must be placed only into a suitable, mature and fully cycled aquarium.

We may contact you for information about your aquarium before accepting a livestock order. We reserve the right to refuse or cancel a sale where we reasonably believe:

  • The proposed aquarium is unsuitable;
  • The animal may be at risk;
  • The order appears unlawful;
  • Delivery cannot be completed safely; or
  • Continuing with the sale would conflict with our animal-welfare responsibilities.

If we cancel for one of these reasons before dispatch, payments for the cancelled items will be refunded.

5. Placing an order

The website allows you to submit an offer to purchase the items in your basket.

An automatic order confirmation acknowledges that we have received your order but does not necessarily mean that it has been accepted.

A contract is formed when we confirm dispatch or otherwise expressly accept the order. We may reject an order before acceptance because:

  • An item is unavailable;
  • A price or product description contains an obvious error;
  • Payment has not been authorised;
  • We cannot deliver to the address provided;
  • Livestock is not fit or ready to travel;
  • Weather or courier conditions make livestock delivery unsafe; or
  • We reasonably suspect fraud or misuse.

If payment has been taken for a rejected order, the relevant amount will be refunded.

6. Prices and payment

Prices are shown in pounds sterling and include VAT where applicable.

Delivery charges are displayed during checkout before the order is submitted.

Payment may be processed through Stripe or PayPal. Your use of a payment provider may also be subject to that provider's terms and privacy notice.

We must receive cleared payment before dispatch.

If a price is clearly incorrect and could reasonably have been recognised as an error, we may cancel the affected item and refund the payment even if an order confirmation has been issued.

7. Discount codes and store credit

Discount codes:

  • Must be used before their expiry date;
  • Cannot normally be exchanged for cash;
  • May be limited to particular products or customers;
  • Cannot be used more than once unless stated otherwise; and
  • Cannot be combined unless expressly permitted.

Store credit has no cash value and may only be used against eligible Tropaquatics purchases. Your statutory rights concerning refunds are not replaced by store credit unless you freely agree to accept it.

8. Delivery area

We deliver to eligible addresses in mainland Great Britain, meaning England, Wales and mainland Scotland, subject to courier availability.

We do not currently guarantee livestock delivery to Northern Ireland, the Channel Islands, the Isle of Man, Scottish islands or other offshore or restricted locations.

Some remote postcodes may carry an additional charge or may not be eligible for livestock delivery. We will contact you before dispatch if this affects your order.

Orders may be carried by Royal Mail, DX, DPD, DHL or another appropriate delivery provider.

9. Delivery dates

Estimated dispatch and delivery dates are provided in good faith but are not guaranteed unless we expressly agree otherwise.

Livestock dispatch may be postponed because of:

  • Extreme temperatures;
  • Severe weather;
  • Public holidays;
  • Courier restrictions or disruption;
  • Concerns about an animal's health; or
  • Any other animal-welfare concern.

We will try to notify you of material changes and arrange the next suitable delivery date.

Non-livestock goods will normally be delivered within 30 days unless a different timescale has been agreed.

10. Receiving livestock

A responsible adult must be available to accept livestock at the delivery address.

You must:

  • Provide a complete and accurate address;
  • Monitor courier tracking and delivery notifications;
  • Bring the parcel indoors immediately;
  • Inspect the livestock promptly;
  • Follow our acclimatisation instructions; and
  • Report any DOA within one hour of recorded delivery.

Do not request that livestock is left unattended or in a safe place.

Redirecting, rescheduling or changing the delivery after dispatch may affect eligibility under our voluntary DOA guarantee where this causes or contributes to loss.

11. Risk and ownership

For consumer orders, responsibility for goods passes to you when the goods come into your physical possession or the possession of a person identified by you to receive them.

Ownership of non-livestock goods passes to you once we have received payment in full and delivery has taken place.

12. Cancelling non-livestock orders

If you are a consumer purchasing online, you will normally have the right to cancel an order for non-livestock goods within 14 days after receiving them, without giving a reason.

To cancel, email info@tropaquatics.co.uk with your name, order number and a clear statement that you wish to cancel.

After notifying us, you must return the goods within 14 days. Unless the goods are faulty, damaged or incorrectly supplied, you are responsible for the direct cost of returning them.

Goods must be handled only as much as necessary to establish their nature, characteristics and function. We may make a lawful deduction where avoidable handling has reduced their value.

Refunds will be made using the original payment method unless otherwise agreed. We may withhold the refund until we receive the returned goods or evidence that they have been sent back.

13. Exceptions to change-of-mind cancellation

Change-of-mind cancellation rights may not apply to:

  • Live fish, shrimp, snails or other livestock once dispatched, because of their perishable nature and welfare requirements;
  • Perishable or rapidly deteriorating products;
  • Sealed goods unsuitable for return for health-protection or hygiene reasons once unsealed;
  • Fish food or similar products where a health or hygiene seal has been broken; and
  • Products made or ordered to a customer's specification.

Please contact us as quickly as possible if you wish to cancel livestock before dispatch. We will try to stop the order, but this may not be possible once livestock has been packed or handed to the courier.

This section does not remove your rights where an item is faulty, misdescribed, damaged or not supplied with reasonable care.

14. Faulty, damaged or incorrect goods

Goods must be as described, of satisfactory quality and fit for any purpose made known to us where the law requires.

If a non-livestock item is faulty, damaged or incorrect, please contact us promptly with your order details and supporting photographs where appropriate.

Depending on the circumstances and your statutory rights, a repair, replacement, price reduction or refund may be available.

Damage caused by misuse, incorrect installation, accidental damage, normal wear, failure to follow instructions or unsuitable aquarium conditions is not treated as an inherent fault.

15. Livestock problems and DOA claims

Our Live Arrival and DOA Policy forms part of these terms.

A valid DOA claim must normally be reported within one hour of recorded delivery and supported by clear evidence showing the affected animal inside its unopened and sealed transport bag.

For an accepted claim, we will normally offer a refund or store credit for the purchase price of the affected livestock. Delivery charges are not normally included unless required by law.

The DOA reporting procedure helps us verify what occurred during delivery. It does not unlawfully remove any statutory remedy that may apply.

16. Death or illness after delivery

Aquatic livestock can be affected by water chemistry, temperature, acclimatisation, aquarium maturity, tank mates, disease already present in an aquarium and ongoing husbandry.

We cannot guarantee the survival or future health of livestock after it has been safely delivered and introduced into the customer's aquarium.

If you experience a problem, contact us promptly with:

  • Water-test results;
  • Aquarium temperature;
  • Tank size;
  • Acclimatisation details;
  • Photographs or video; and
  • Information about other livestock in the aquarium.

We will try to provide reasonable guidance, but such guidance does not replace advice from a suitably qualified aquatic veterinarian.

17. Returns address

Do not return livestock or other goods without contacting us first.

Returning live animals through an ordinary postal service may be unlawful or unsafe. We will provide instructions where a return is appropriate.

18. Our liability

We are responsible for losses that are a foreseeable result of our breach of these terms or failure to use reasonable care and skill.

We are not responsible for losses that were not foreseeable, avoidable losses caused by the customer, or business losses arising from a consumer purchase.

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

19. Events outside our control

We are not responsible for delay or failure caused by circumstances outside our reasonable control. These may include severe weather, courier-network disruption, transport restrictions, power failures, strikes, disease-control restrictions or interruption to communications systems.

Where livestock is involved, animal welfare will take priority. We may delay dispatch until safe arrangements are available.

20. Website use and intellectual property

Website content, branding, photographs, graphics and text owned by Tropaquatics may not be copied, reproduced or used commercially without written permission.

Care information is provided as general guidance. Species requirements can vary, and customers remain responsible for conducting appropriate research and maintaining suitable conditions.

We do not guarantee that the website will always be available, uninterrupted or free from technical errors.

21. Personal information

We use personal information in accordance with our Privacy Policy.

22. Changes to these terms

We may update these terms to reflect changes to our business, website, delivery services or legal obligations.

The terms applying to an order will normally be those published when the order was placed. Material retrospective changes will not be made to an existing contract without a lawful reason.

23. Complaints

Please send complaints to info@tropaquatics.co.uk.

Include your name, order number and a clear description of the issue. We will aim to acknowledge and investigate complaints within a reasonable period.

24. Governing law

These terms and any contract between us are governed by the laws of England and Wales.

If you are a consumer living elsewhere in the United Kingdom, you retain any mandatory protections provided by the law of the part of the UK in which you live. You may bring proceedings in any court that has jurisdiction under applicable law.
